Antitrust Verdict for Endo

July 01, 2022

A team from Dechert and co-counsel Williams & Connolly won a jury verdict in an antitrust class action for client Endo Pharmaceuticals (Endo) in the Northern District of Illinois.

Plaintiffs had challenged a 2010 patent settlement agreement between Endo and Impax Laboratories under a so-called “reverse payment” theory. The jury found that the settlement was not anticompetitive under the antitrust rule of reason.

The Dechert team defending Endo was led by antitrust partners George Gordon and Julia Chapman and intellectual property partners Martin Black and Robert Rhoad; and included antitrust associates Forrest Lovett, John McClam, Thomas Miller, Jennifer Harchut and David Costigan; intellectual property counsel Sharon Gagliardi and associates Brian Goldberg and Daniel Roberts; and litigation partner Steven Engel.
