Dechert Secures Favorable Decisions in Two IPR Proceedings for IOENGINE

On February 7, Dechert LLP secured favorable decisions for client IOENGINE, owner of a suite of patents covering a connection and communications protocol for portable devices, in two inter partes review (IPR) proceedings filed by digital media player manufacturer Roku.

The Patent Trial and Appeal Board (PTAB) denied Roku’s request for institution of IPRs on IOENGINE’s ’819 patent, meaning that the patent, which Dechert continues to actively litigate against Roku in district court, will not be subject to validity review by the PTAB.

“In the vast majority of petitions, an IPR is instituted,” Dechert partner Greg Chuebon explained. “And most IPRs result in at least some claims being found unpatentable. So, we are pleased to have gotten two IPRs denied institution for IOENGINE.”

Chuebon added, “Not only did IOENGINE’s patent survive this process, but the PTAB said that Roku didn’t have a reasonable likelihood of succeeding in their challenge, so they refused even to open an IPR proceeding.”
