Dechert Secures Complete Victory for IOENGINE in IPR Proceedings

On May 5, Dechert LLP secured favorable decisions from the Patent Trial and Appeal Board (PTAB) for client IOENGINE, owner of a suite of patents covering a connection and communications protocol for portable devices, in four inter partes review (IPR) proceedings filed by streaming media player manufacturer Roku. This follows a similar ruling defeating IPR institution on two other Roku petitions involving a separate IOENGINE patent achieved earlier this year, resulting in a six-for-six victory for the client in the PTAB.

The PTAB’s denial of Roku’s requests for institution of all six of Roku’s petitions for IPR on IOENGINE’s ’819 and ’584 Patents means that those patents will not be subject to validity review by the PTAB.

In denying each of the final four petitions for IPR filed by Roku, the PTAB agreed with IOENGINE’s arguments that Roku’s Petitions failed to present a “compelling, meritorious challenge” to IOENGINE’s ’584 Patent.”
